An asylum seeker is a person who has applied to the UK Border Agency (UKBA) of the Home Office to be recognised as a refugee, but who has not yet received a decision, or is in the process of appealing against an initial rejection of her/his claim for asylum. S/he may also be a person who has applied for recognition as a refugee or for leave to remain in the United Kingdom because her/his rights under the European Convention on Human Rights may be breached if s/he is removed.
